Old topic, new question

Hi all,

I've just did a google search in RCTY to see if I could find the answer to my
question and after reading all the copyright ones, didn't really find what I am
looking for so I'll ask all of you the question.

I have from some magazine (the name doesn't appear on the pages) it was
something like a Woman's Day, Family Circle or that size from either the late
50's early 60's. I cut out the sweater pattern and picture that I wanted and
have kept it all these years and used it many times. Now my question is, can I
make a copy and send it to someone else for their personal use. I've done a
google search to see if I could find it, but didn't come up with it. I can't
contact the publisher as I don't know which magazine it came from so I'm at a
loss of what I can do.

Now that is interesting, Nora. You have done what you can to find the
original source, and I would say that you have covered yourself. Of course,
someone may say the exact opposite, but I think that I would go ahead and do
it.

Maybe you could put a disclaimer on the copy telling that you are ready
to pay the designer/publisher or/and his heirs for the copy.
I´ve seen it more than once in books when the publisher wasn´t able to
trace down the legal owner of the copyright, like reprints of old
translations or photos...

I would say yes......Your friend may have bought the same magazine, with
the same pattern in it and she could have lost it. This is sharing of a
pattern you bought when you got the magazine. After all you are not
selling the pattern, or running a hundred copies of and giving these
away. And you are also not claiming it as your own. Say that your friend
had found this magazine in the Sally Ann store and bought it because of
the pattern that got her attention......share the pattern and do not worry
about it, enjoy.

Now, I feel better knowing I can pass it along to a friend. When I took it out,
I never remember anything about copyright. After working in a R&D library for
25 years I thought it best to ask.

I agree with Els...if I were to buy that magazine in a thrift store, I'll
bet money that the only person profiting from the magazine is the store
owner! lol

I had to deal with a lot of awkward copyright stuff when I was at Uni doing
my dissertation - articles especially and those in magazines (which I've
checked against my knitting patterns from publications of all sorts) and the
usual legal-ese somewhere in the small print generally says that you may not
reproduce any part of the magazine for commercial purposes. Photocopying
part of the content of the magazine to give to a friend without monetary
gain on your part is perfectly okay- according to all the UK rules anyway.
If you were to quote it, reproduce it for a publication of your own, publish
it on a website or even use the ideas in it for anything for which you
charged money then the copyright holders might come after you (assuming they
found out about it and you'd made enough money out of it to make suing you
worthwhile). To do any of those you'd have to get permission from the
author/ publisher first. But as that isn't the case you should be okay!

That's how things stand over here, anyway. Knew I'd get some use out of that
thesis!
