Before I had a chance to change the name there were two bids on it and now I
would have to close the auction to change it, so if I get any flack from the
marrs company I'll take it down

I think the trademarked name is M&M, not M n'M, so you may be safe on a
technicality.

ok so lets say I make Crayons and my name is Morris and my partner's name is
Mitchell and we start a company called MnM, I would be sued for copyright
infringement, if that is the case nobody can ever have the initials MM. Why
stop there lets sue everyone with the letter M on there packaging

I have a little trouble with copyright stuff sure I understand and agree
with not copying other company's products but if your using a similar name
but the product is not the same why should there be a problem its not like
I'm trying to attract candy customers and my beads don't have little arms
and eyes or even the M on them.

Don't gang up on me - just my opinion

believe it or not -- it HAS HAPPENED..
McDonalds, Mars, and many other companies have sued other "legitimate" but
similarly named companies....
didn't you see just recently the
settlement between MICROSOFT
the giant corporation - who was suing
a guy named Mike Rowe -- who put up a website named
MikeRoSoft

No it is not worth it, we made a mistake in our description
that I wanted to change, my wife listed them before she talked to me about
them and we later agreed that no mention of chocolate should have been
written, also we could have chosen a better name

I was just wondering about the name and how can anyone
sue because another company used M, MNM, MN'M, M's (of course unless they
looked like colorful lentil chocolate, LOL)

" part of the problem here is that it would be obvious to anyone looking
at it that you were playing on the popularity of M&M chocolate candy.
colors, shapes, etc. and that other one you posted is in even MORE
trouble, because they put the "M" on the beads.

i can design anything i want with Winnie the Pooh on it - as long as i
only do it for myself or give it to someone. the problems start the
minute i put it up for sale - because Disney is JUST as adamant about
protecting their copyright as is the Mars Candy Company [or whoever
makes M&Ms.

a judge would make the ultimate determination. IMO, in this case the
two beadmakers would lose - big time.

remember when Apple came into being? the Beatles came to an agreement
with them that they could use "Apple" only so long as they stayed away
from music. when Apple Computers crossed that line, the Beatles sued.
now, eventually, the Beatles lost. probably because Apple wasn't
actually CREATING music - just making it available for listening - but
it was a close call.

that 2nd site you posted is REALLY pushing their luck, because even
their description SAYS they're imitating the candy. they could even
lose their business. is it worth it?????
