Believe it or not, it's the retailer that sets the name. Example: I once had a
friend walk into a store and said, "I'd like to look at that bong, please." Retailer's response: "I'm sorry, sir, we don't sell bongs here. I'm afraid you'll have to leave now." He did so, walked back in, and said, "I'd like to look at that water pipe, please." Retailer's response: "Certainly, sir, I'd be glad to help you." Yes, they have made the NAME "bong" illegal, but NOT the product! As long as there is the possibility the item can be used for smoking some LEGAL substance, such as tobacco or herbal blends, then only the NAME "bong" is illegal. Evidence all the "smoke shops" here in Sandy Eggo! They ALL sell a large variety of glassware used for smoking, but as long as they can be used for tobacco they are legal. I think this guy's attorneys are right -- as long as he is careful about the name, he is okay.
